Back in 2005 Texans passed an anti-gay marriage amendment to the state constitution. Unfortunately the legislators (or rather the AFA lobbyists) who wrote the bill got a little bit sloppy when they added a provision meant to prevent civil unions or the granting of any rights to domestic partners:

"This state or a political subdivision of this state may not create or recognize any legal status identical or similar to marriage."

Apparently it didn't occur to them that "Marriage" is identical or similar to marriage ... They forgot to include language that limits that clause to same sex couples.

Marriage continues in the state of Texas as if it is legal (and probably still is as far as Federal rights and benefits are concerned), but there is concern that this constitutional gaffe may be exploited by insurance companies to deny benefits or be used in lawsuits to deny inheritance or even spousal rights.
